Introduction

These Terms and Conditions ("Terms") apply to all visitors and customers of Lumee Co Pty Ltd (referred to as "Lumee", "we", "us", or "our"). By accessing our website or purchasing our festoon light kits, globes, and accessories, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should refrain from using our website or services. These Terms constitute a legally binding agreement between you (the "user" or "customer") and Lumee Co Pty Ltd regarding the use of our website and the purchase of products from us. Please read them carefully. We may update these Terms from time to time by posting a revised version on our website, and your continued use of the site after any changes indicates your acceptance of the updated Terms.

Shipping & Delivery

Lumee currently offers domestic shipping within Australia only. We do not ship internationally at this time. All orders are processed and dispatched as quickly as possible, typically within our stated processing times on the website (business days). Delivery times may vary depending on your location and the courier. While we strive to meet estimated delivery dates, we are not responsible for delays caused by postal or courier services or other factors beyond our control.

We take great care in packaging your order, but if your goods are lost in transit or arrive damaged, please contact us at hello@lumee.com.au as soon as possible. We will investigate the issue and, in compliance with Australian Consumer Law, arrange either a replacement shipment or a full refund for the affected items. Lumee reserves the right to request evidence of loss or damage (such as photographs of damaged goods or packaging) to facilitate claims with our delivery providers. Rest assured, if the loss or damage is confirmed, we will cover any reshipping costs for replacements. Your satisfaction and confidence in ordering from us are very important, and we will work with you to resolve shipping problems promptly.

Returns & Refunds

If you need to return a product or seek a refund, please refer to our Returns Policy. The Returns Policy will provide detailed instructions on how to return items, eligibility for returns (such as change-of-mind returns, if applicable), and the refund or exchange process. In general, we adhere to all requirements of the Australian Consumer Law regarding returns and refunds. This means you are entitled to a replacement or refund for major failures or faults with the products, and to compensation for any other reasonably foreseeable loss or damage. For minor faults, we will gladly offer a repair or replacement. For any return or warranty claim, we will require proof of purchase (such as your order number or receipt).

Nothing in these Terms or our Returns Policy is intended to limit or exclude any rights you have under Australian Consumer Law.

Warranty (12-month Limited Warranty)

Lumee Co Pty Ltd provides a 12-month limited warranty on all festoon light kits, globes, and lighting accessories sold through our website. This warranty is valid for 12 months from the date of purchase and covers any faults or defects in materials and workmanship under normal use. If your Lumee product malfunctions or fails due to a manufacturing defect within this period, we will, at our discretion, either repair the product, replace it with an equivalent new product, or provide a refund of the purchase price. This express warranty is provided in addition to other rights and remedies you may have under the Australian Consumer Law.

Warranty Exclusions: This warranty does not cover certain situations. For example, it does not cover: accidental breakage or damage (such as dropping a globe and breaking it), misuse or abuse of the product, neglect, improper storage, or installation-related damage. If the product is not installed or used according to the provided instructions or is modified (including cutting or altering cables, or using non-recommended bulbs or accessories), any resulting damage or faults are not covered by our warranty. Normal wear and tear, and consumable components (such as light bulbs burning out after their normal life expectancy), are also generally not covered as faults. The warranty applies only to the original purchaser of the product and is not transferable to third parties.

To make a warranty claim, please contact us at hello@lumee.com.au with your order information, a description of the issue, and any supporting evidence (e.g., photos of the defect). We will guide you through the warranty claim process. You may be required to return the defective product to us for inspection or provide additional details. If we determine that the issue is covered by our warranty, we will repair or replace the item (or refund you) in a timely manner at no additional cost. Any repaired or replaced item will be covered by the warranty for the remainder of the original warranty period or 3 months from the repair date, whichever is longer, as required under consumer law. Please note that you are responsible for safely shipping the product back to us if requested, but if the claim is approved, we will reimburse any reasonable shipping costs you incurred.

This 12 month limited warranty gives you specific legal rights. Nothing in this warranty limits or excludes your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under that law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, and you are entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Payment Terms

All payments for orders on Lumee’s website are processed securely via Shopify Payments. We accept all standard payment methods available through Shopify Payments, including major credit and debit cards (such as Visa, MasterCard, and American Express) and other popular payment options that may be offered at checkout. By completing a purchase, you authorize Shopify Payments and Lumee Co Pty Ltd to charge the provided payment method for the total order amount (including any applicable shipping fees and taxes). Payment must be received in full before we dispatch your order. We do not offer cash on delivery or credit terms; all transactions are charged at the time of purchase.

All prices listed on our website are in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable, unless stated otherwise. If you are using an international payment method or bank, be aware that currency conversion fees or international transaction fees might be applied by your bank (these are outside our control). We utilize industry-standard encryption and security measures to protect your payment information. Lumee does not store your full credit card details; all sensitive payment information is handled by our payment gateway (Shopify Payments) in accordance with their security protocols.

In the event of a pricing error or an error in product information, Lumee reserves the right to cancel or refuse any orders placed for the mispriced or misdescribed item. If this occurs, we will contact you as soon as possible and provide a full refund of any amount you have paid for the cancelled order. We strive to ensure accuracy in pricing and product details, but mistakes can happen, and we appreciate your understanding.

Intellectual Property

All content on the Lumee website – including text, product descriptions, images, graphics, logos, videos, design elements, and software – is the intellectual property of Lumee Co Pty Ltd or its content suppliers and is protected by copyright, trademark, and other applicable intellectual property laws. This includes the Lumee brand name, logo, and any other trademarks or service marks owned by Lumee Co Pty Ltd. All such trademarks, along with any third-party trademarks displayed on our site, remain the property of their respective owners. Nothing in these Terms constitutes a transfer or grant of any intellectual property rights to you.

You are granted a limited, revocable license to access and use the website content for your personal, non-commercial use in connection with shopping for our products. Prohibited uses of content: You may not reproduce, copy, modify, distribute, transmit, display, perform, or otherwise use any part of our website or its content without our prior written permission, except as allowed by law (such as brief quotations for commentary or fair dealing uses). In particular, you must not use any Lumee trademarks, logos, or branding without authorization. Any unauthorized use of our intellectual property may result in legal action. Our products are intended for use by the end-consumer (personal or business use in installations) and not for unauthorized distribution. Using the products contrary to the instructions or warnings provided voids any warranty and is at your own risk.

This means you may not introduce any destructive or malicious code, viruses, worms, or malware, nor attempt to hack, attack, disable, overburden, or impair our website or any related system or network.

In no case shall Lumee’s total aggregate liability for any claim arising out of these Terms or the use of our products or website exceed the amount you paid to us for the specific product or order in question. If you did not make a purchase and are claiming loss related to use of the website, our liability will be zero (as use of the website alone is provided free of charge). To the extent that any law (such as the Australian Consumer Law) implies a warranty or guarantee or imposes an obligation on Lumee that cannot be excluded or limited by contract, our liability for breach of that condition or warranty will (at our option) be limited to the replacement of the goods or supply of equivalent goods, the repair of the goods, or the cost of doing so. Nothing in these Terms is intended to exclude or restrict any non-excludable rights or remedies you may have under law. However, beyond those rights, any liability that cannot legally be excluded is limited as far as the law allows.

You agree that, to the extent permissible by law, any claim or cause of action arising out of or related to your purchase or use of Lumee products or the website must be brought within a reasonable time and, in any event, within one (1) year after such cause of action arose, otherwise it will be barred (this does not apply to consumer guarantees under ACL). This limitation is aimed at ensuring timely resolution of issues.

Governing Law

These Terms and Conditions, and any separate agreements by which we provide you services or sell you products, are governed by and construed in accordance with the laws of Australia. By using our website or purchasing our products, you submit to the non-exclusive jurisdiction of the courts of Australia for the resolution of any disputes. In practice, if a dispute arises that leads to litigation, it may be heard in the courts of the state of our principal business operations or your state of residence, as determined by applicable rules of jurisdiction.
